The petitioners seek bail in Bahera P.S. Case No. 120 of 2019 registered under Section 147, 149, 341, 323, 337, 379 & 302 of the Indian Penal Code.

Over row of playing DJ on hell of the voice 22 accused persons including the petitioners assaulted the informant and his brother by means of lathi. His brother, namely, Ramchandra Mochi succumbed to injury during the course of treatment.

Patna High Court CR. MISC. No.33241 of 2019(2) dt.20-05-2019 2/2 It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. The petitioners have committed no offence and have no concern with the aforesaid occurrence. They have been falsely implicated in this case due to dirty village politics. The allegation levelled against the petitioners are not specific rather general and omnibus in nature. The doctor has found only two injuries on the person of the deceased but the assailant of the said injury is not ascertained. The petitioners have no criminal antecedent and have been languishing in custody since 23.03.2019. Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P.S.
