Case No.438 of 2014 for the offence instituted under Section 364 of the I.P.C.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that there is accusation against the co-accused persons including the petitioner of planning in the hotel of the petitioner to kidnap the son of the informant two days prior to the occurrence because thereafter son of the informant had gone out on his motorcycle and he did not return his house.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.26736 of 2015 (3) dt.12-08-2015 2/2 petitioner is in custody since 1.9.2014 and the charge sheet has been submitted in the present case. The petitioner is not named in the F.I.R. Other co-accused have already been granted bail vide Cr.Misc. No.18166/15.
On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Kishanganj, in connection with S. Tr.No.104/15 arising out of Kishanganj P.S. Case No.438 of 2014. (Sudhir Singh, J) AnilKrSinha/- U T
