JUSTICE SUDHIR SINGH ORAL ORDER 09-06-2015 The petitioner is languishing in custody since 25.10.2014 in connection with Lalganj P.S. Case No. 257 of 2014 for the offence instituted under Section 302/201 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 22.10.2014 at about 11.00 A.M., uncle of the informant was called by the accused persons including the petitioner on the pretext of some land deal and thereafter they committed murder of his uncle and threw the dead body in the field. On this information, the informant went there and found his uncle dead. It has been submitted on behalf of the petitioner that it is a case of last seen and there is no direct allegation against the

Patna High Court Cr.Misc. No.16248 of 2015 (2) dt.09-06-2015 2/2 petitioner and not even a circumstantial evidence shows about the participation of the petitioner in the crime. Further it has been submitted that the petitioner has got no criminal antecedent and he is in custody since 25.10.2014.

It has been submitted on behalf of the State that there is direct allegation against the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S.
