The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

Heard the learned counsel for the petitioner as well as Mr. Narendra Kumar Singh, learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Pandaul P.S. Case No. 05 of 2021 registered for offence punishable under Sections 366A/34 of the Indian Penal Code. As per allegation, the petitioner entice away the minor daughter of the informant.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.45949 of 2021(2) dt.15-04-2022 2/2 in her statement recorded under Section 164 of the Cr.P.C. the victim has stated that she had love and affection with the petitioner. She herself called the petitioner and on her pressure, the petitioner brought her to Bombay and the petitioner never gave any pressure upon her. In her statement, she expressed her willingness to go with the petitioner and not with her mother. Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No. 05 of 2021, subject to condition as laid down under Section 438 (2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
