The petitioner is languishing in custody since 31.12.2015 in connection with Araria P.S. Case No. 662 of 2015 (G.R. No. 3807/2015) for the offences instituted under Section 25(1-b) A, 26 and 35 of the Arms Act.

The recovery is of illegal arms and ammunition from possession of the petitioner and one other co-accused. It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.12. 2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering with the evidence against the petitioner. From perusal of the F.I.R. and seizure list, it is evident that no compliance of

Patna High Court Cr.Misc. No.20219 of 2016 (3) dt.18-07-2016 2/2 Section 100 Cr. P.C. has been made. The other co-accused has been granted bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 13539/2016.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria, in connection with Araria P.S. Case No. 662/2015(G.R. No. 3807/2015).
