Petitioner seeks bail in Bahera P.S. Case No.232 of 2018 instituted for the offence under Section(s) 341, 323, 326A, 307, 504/34 Indian Penal Code pending in the Court of the 2nd A.D. J., Benipur, Darbhanga.
Prayer of the petitioner for bail was earlier rejected by this Court with liberty to renew the prayer for bail after six months if no substantial progress is made in the trial. In the written report, it is alleged that this petitioner along with other accused threw acid on the face of the informant and his other family members on account of which five persons sustained burn injury with acid. All the injured were taken to DMCH.

No.32432 of 2019(3) dt.10-07-2019 2/2 A report has been received from the Court below that on account of indisposition of the accused persons, they are not appearing in the Court and charge could not be framed. Trial Court has submitted that after framing of Charge, trial will be concluded within six months.
Keeping in view direct allegation of causing burn injuries against the petitioner, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected. The Trial Court is directed to frame Charge within fifteen days from the date of receipt of a copy of this order and make all efforts to conclude the trial as early as possible, preferably, within a period of six months from the date of framing of Charge and send compliance report to this Court.
