====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-08-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Birpur Thana P. S. Case No. 216/2024 in a case registered for the offence punishable under Section 25(1-AA) of the Arms Act.

3. As per prosecution case, on the basis of secret information, a raid was conducted and during search, one country made pistol, one revolver, one 7.65 mm pistol, 16 pieces of 8 mm cartridge and other articles were recovered from the house of co-accused Surendra Mahto.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is not named in the F.I.R. and he

Patna High Court CR. MISC. No.36902 of 2025(2) dt.01-08-2025 2/2 has been made accused only on suspicion. Petitioner is in custody since 26.01.2025. Charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class-cum-A.M., Begusarai in connection with Birpur Thana P. S. Case No. 216/2024.
