JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek regular bail in a case registered for the offences punishable under sections 147, 148, 149, 302, 120-B, 379 of the Indian Penal Code and section 27 of the Arms Act.
The informant has alleged in the F.I.R. that when he reached in the field of wheat for harvesting, all the accused persons surrounded his grand father and his family members duly armed and assaulted them. There was indiscriminate firing by the accused persons. Baleshwar Rai shot dead the grand father of the informant and thereafter the accused persons fled away.
Patna High Court Cr.Misc. No.26733 of 2015 (2) dt.27-07-2015 On behalf of the petitioners it is submitted that the petitioners are in custody since 12.05.2015 and 28.04.2015. It is further submitted that the main allegation of assault is against one Baleshwar Rai.
On behalf of the State and the informant, it is submitted that the petitioners are named in the F.I.R. Considering the facts aforesaid, let the petitioners above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Arrah in connection with Barahara P.S. Case no. 101 of 2015.
