JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case registered under Sections 147, 148, 149, 323, 324, 307 and 302 of the Indian Penal Code and 27 of Arms Act.
Accusation is that the informant along with Vivek Kumar, Lovely Kumar and Dharmendra Kuma were talking in the lane and at that time four miscreants, named in the FIR, including the petitioner and 3 to 4 unknown persons came there and started assaulting him by fists and slaps. Kislay Kumar and Sudhir opened fire causing fire arm injury to Vivek Kumar and Lovely Kumar whereas Dharmendra Kumar sustained knife injury. Vivek Kumar and Lovely Kumar died in the way while they were being brought
Patna High Court Cr.Misc. No.20716 of 2016 (2) dt.19-05-2016 2/2 to hospital for treatment.
The submission is that though the petitioner is named in the FIR, no overt act has been attributed against the petitioner and the petitioner is in custody since 13.11.2015. Further submission is that Bikki Kumar has been allowed bail by a Bench of this Court in Cr. Misc. No. 18021 of 2016 on 29.4.2016.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ravindra Kumar, learned Judicial Magistrate- 1st Class,Biharsharif, Nalanda, in connection with Silao P.S.Case No. 180 of 2015.
