2. This application has been filed for direction to the respondents particularly respondent no. 6 Circle Officer, Paliganj to initiate an encroachment proceeding against the private respondents for removal of encroachment made by them over the land in question.

3. The petitioner is directed to file a fresh application before the Circle Officer, Paliganj for removal of

Patna High Court CWJC No.8771 of 2023(2) dt.23-11-2023 2/2 encroachment.

4. If any encroachment is found by the Circle Officer then he will initiate an encroachment case and after hearing all the concerned parties including the alleged encroacher, he will pass an order in accordance with law within six months from the date of filing of the application.

5. Let a copy of this order be communicated to the District Magistrate-cum-Collector, Patna through FAX for its compliance forthwith.

6. With the aforesaid observation and direction, this application is disposed of.
