JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-04-2019 Learned counsel for the petitioner submits that at this stage instead of seeking setting aside of the order dated 15.09.2018 passed by the District Magistrate, Patna as contained in Annexure '2' to the writ application, the petitioner is only looking for a direction to the District Magistrate, Patna to consider the representation of the petitioner as contained in Annexure '6' to the supplementary affidavit filed on behalf of the petitioner. The emphasis is on that now from letter no. 168 dated 18.03.2019 written by the Fire Fighting Officer, Patna it would appear that the petitioner has removed all the defects and

A copy of the letter no. 168 dated 08.03.2019 is enclosed with the representation as contained in Annexure '6' to the supplementary affidavit. Learned counsel for the State has no objection to this Court issuing a direction to the District Magistrate, Patna to look into the representation of the petitioner together with the recommendations of the Fire Fighting Officer as contained in Letter No. 168 dated 08.03.2019, consider the same and pass a final order thereon.

In the aforesaid view of the matter, this writ application is disposed of with a direction to the District Magistrate, Patna to consider the representation of the petitioner together with the letter of the Fire Fighting Officer as stated above within a period of sixty days from the date of receipt/production of a copy of this order. The District Magistrate shall pass a reasoned order thereon which will be communicated to the petitioner within the said period. This application stands disposed off accordingly.
