JUSTICE RAKESH KUMAR ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner, learned AC to AAG No. 6 as well as Smt. Binita Singh, learned counsel, who has appeared on behalf of respondent/ Lalit Narayan Mithila University.
The petitioner, who claims to be son of an employee, who retired in the year 1997 and died in the year 1998, has approached this court invoking its writ jurisdiction under Article 226 of the Constitution Of India with a prayer to direct the respondents to make payment of retiral dues. In the prayer portion of the writ petition no specific claim has been made. Only a statement has been made for payment of retiral and other dues, which have not been paid.
Patna High Court CWJC No.1910 of 2014 (6) dt.09-01-2015 2/2 The present writ petition was filed in the month of January, 2014. Obviously after more than 15 years from the date of death of employee. In view of the facts and circumstances, particularly in absence of any specific prayer made in paragraph no. 1 or prayer portion of the writ petition and the fact that petitioner has approached this court after such a long time, no relief can be granted.
The petition stands dismissed.
