The petitioner being the husband of the informant is languishing in custody since 04.02.2015 in a case registered for the offences punishable under Sections 498A, 341, 323, 326, 307/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

The basic accusation is of torture for nonfulfillment of the dowry demand. It is also alleged that the petitioner caused burn injury to the informant. It is submitted by learned counsel for the petitioner that the injury has been found to be simple, the informant has retracted from the initial version and filed a petition

Patna High Court Cr.Misc. No.30125 of 2015 (2) dt.23-07-2015 2/2 to that effect before the learned court below. The same has been brought on record as Annexure-2. Moreover, the investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Biroul at Benipur, District - Darbhanga in connection with Biroul P.S. Case No. 63 of 2014.
