====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/120B/34 of the Indian Penal Code.

As per the prosecution case, petitioner and other under trial accused persons while suffering judicial custody in barrack 3⁄4, killed one of their companion prisoners Ram Balak Rai in the night.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He is not named in the FIR. No substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. Similarly

Patna High Court CR. MISC. No.44967 of 2021(3) dt.06-12-2021 2/2 situated co-accused has already been allowed bail by a coordinate bench of this Court vide paragraph 9 of the bail petition. Petitioner is in custody since 8.3.2021. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Sadar Police Station Case No. 358 of 2013.
