As prayed, learned counsel for the petitioner is permitted to make correction in paragraph-13 of the bail petition regarding period of custody during the course of the day. The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

5.400 liters of foreign liquor is said to have been recovered from the bush located in the field of Manan Chamar on the indication of the petitioner which was kept there by him. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious

He has no concern either with the seized liquor or the place of recovery or any trade of liquor. He has been falsely implicated in the case at the instance of his enemies due to dirty village politics. No liquor was seized on the basis of his disclosure. He has been languishing in custody since 12.03.2019.

Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Siwan in connection with Raghunathpur P.S. Case No.40 of 2019.
