JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially, registered for the offences punishable under Section 379 of the Indian Penal Code and later on, Sections 401, 414, 411, 413 of the Indian Penal Code was also added.

The stolen motorcycle of present case was recovered from possession of co-accused, Balmakund Kumar @ Baila, who confessed his guilt leading to recovery of another motorcycle in front of house of the petitioner. Admittedly, the aforesaid motorcycle has not been recovered either from conscious possession of the petitioner or from the house of the petitioner.

Patna High Court Cr.Misc. No.20367 of 2016 (2) dt.09-05-2016 2/2 Moreover, petitioner is in jail custody since 22.03.2016 and does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 110 of 2016.
