JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 36, 41 of Bihar Prohibition and Excise Act, 2016.

In huge quantity Indian made foreign liquor was recovered from a Tata Sumo vehicle and at the time of aforesaid recovery, one motorcycle was also found there. Petitioner happens to be owner of the said motorcycle. Admittedly, nothing was found on the said motorcycle and entire recovery was made from Tata Sumo vehicle.

Considering the aforesaid facts and circumstances as

No.33603 of 2019(2) dt.22-05-2019 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judgecum-Special Judge, Excise Act, Madhubani in connection with Town P.S. Case No. 165 of 2018.
