JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 12.10.2015 in a case registered under section 302/34 of the Indian Penal Code. Altogether seven persons including the petitioner are named in the first information report on the accusation that on the alleged date of occurrence, they took the deceased from his house and, later on, his dead body was recovered. According to the prosecution case, none has seen the actual killing of the deceased and, therefore, even if the prosecution story is assumed to be true, then also, it is a case of last seen. Moreover, charge sheet against the petitioner has already been submitted.
