JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-07-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 307, 326 of the Indian Penal Code. It is alleged against the petitioner that he assaulted with knife to the informant, as a result of which, he sustained injuries on his neck and stomach and blood started oozing from his neck and stomach. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. Prior to the alleged
Patna High Court CR. MISC. No.36061 of 2023(2) dt.04-07-2023 2/3 occurrence, the informant had taken loan of rupees fifty thousands from the petitioner and when the petitioner demanded his money back, this false case has been registered against him. The informant alleged that he received knife blow on his neck and stomach but the doctor has not found any injury on the neck of the informant and except one injury for which opinion has been kept reserved, other injuries are simple in nature. The petitioner is languishing in custody since 16.04.2021. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions
