JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2019 This is an application for grant of anticipatory bail in connection with Hussainganj (M.H. Nagar) P.S. Case No.77 of 2019, disclosing offences under Sections 341, 323, 324, 307, 436, 354B, 379, 504, 506, 34 of the Indian Penal Code. Allegation against the petitioner no.1 is of assault by knife to the son of the informant and there is allegation of assault against other accused persons also and allegation against petitioner no.2 is that he has stolen 10 quintals of wheat from the Khop and set the Khop on fire.

Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and land dispute between the parties also. Though allegation of assault against petitioner no.1, but injuries were found to be

Patna High Court CR. MISC. No.32930 of 2019(3) dt.01-08-2019 2/2 simple in nature, which will appear from Annexure 2 and so far as petitioner no.2 is concerned, the allegation is false and concocted and there is allegation of setting the khop on fire and not the dwelling house.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Hussainganj (M.H. Nagar) P.S. Case No.77 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
