The petitioner seeks bail in connection with Lakhisarai P.S. Case No. 576 of 2014 for the offences punishable under sections 147, 148, 149, 323, 307, 379 and 506 of the Indian Penal Code as well as section 27 of the Arms Act.

The prosecution story, in brief, as per the F.I.R. lodged by the informant, is that he is the Mahanth of Ram Janki Mandir, Harinamchak, and when he came on 10-10-2014 in the premises of the Math, the petitioner along with the accused Satrudhan Singh started abusing and assaulting him by means of Danda, as a result of which he sustained fire arm injury on his abdomen and fell down. It is also alleged that the Pujari Shankar Singh also arrived and the accused persons also fired at him. It is alleged that the petitioners along with other accused persons took away

Patna High Court Cr.Misc. No.17449 of 2015 (3) dt.11-06-2015 2 / 2 Rs.20,000/- after breaking the lock of the room. It has been submitted on behalf of the petitioner that the petitioner though is said have fired in course of occurrence, but did it not injure anyone. It has been further submitted that the main allegation is against Satrudhan Singh, who also fired which hit the informant causing injury to him.

It has been further submitted that the petitioner is in custody since 4-2-2015.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the facts and circumstances of the case, and the fact that no injury has been caused by the petitioner in course of occurrence, let the petitioner Prabhat @ Chuhwa be released on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in Lakhisarai P.S. Case No. 576 of 2014/G.R.No. 1519 of 2014 (Sudhir Singh, J) BK.Roy/- U T
