The petitioner seeks bail in a case for the offences punishable under sections 341, 323, 307/34 of the I.P.C and section 27 of the Arms Act.
The prosecution story, in brief, is that when the informant along with his younger brother sowing his field the petitioner along with other accused persons variously armed came there and petitioner Dharmpal Chaudhary shot at the head of the informant and other accused assaulted the informant by Lathi, Danda and rod.
On behalf of the petitioner it has been submitted that the petitioner is in custody since 15.4..2015. Charge sheet has
Patna High Court Cr.Misc. No.27056 of 2015 (2) dt.28-07-2015 2/2 been submitted in the case. The petitioner has got no criminal antecedent. It is a case and counter case and the injury report does not support the prosecution case.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ankur Gupta, J.M. 1st Class, Khagaria in Chautham P.S. Case No. 50 of 2015. (Sudhir Singh, J) Abhay/- U T
