JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. C-1031of 2018, in which cognizance has been taken under Sections 406/420 of the Indian Penal Code.

As per Complaint petition allegation against the petitioner is that although the petitioner is owner of of only one Katha land but he executed the sale deed with respect to two Katha of land and he he made complaint about the same he also threatened the complainant.

Submission of the learned counsel for the petitioner is that the land is already mutated by the complainant and both the petitioner and complainant belongs to the same family.

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. IV, Muzaffarpur, in connection with Complaint Case No.-C-1031 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
