The petitioner has prayed for bail in a case registered for the offence punishable under sections 379, 411, 413/34 of the Indian Penal Code.

Prosecution case relates to recovery of 50 piece of CPVC pipe from the petitioner while he was carrying it with 3-4 of his associates from a construction side.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. After prevailing good sense, both parties have entered in a compromise and compromise petition is annexed as Annexure2. After completing the investigation police has submitted

Patna High Court CR. MISC. No.35547 of 2023(2) dt.26-06-2023 2/2 charge sheet against the petitioner. Petitioner is languishing in judicial custody since 18.10.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial magistrate 1st Class, Begusarai in connection with Ballia P.S. Case No. 342 of 2021.
