JUSTICE SUDHIR SINGH ORAL ORDER 01-08-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 10.03.2016 in connection with Parsa P.S. Case No. 44 of 2016 for the offences instituted under Section 392 of the IPC.

It is alleged that the bag of the informant containing Rs. 49,752/-and a Pass Machine was snatched by the unknown persons on the point of pistol.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.03.2016 and the charge sheet has been submitted in the present case. The petitioner is not named in the F.I.R. His name has come in course of investigation. There is no recovery of any looted article from conscious possession of the

On behalf of the State it has been submitted that from perusal of paragraph nos. 7 and 8 of the case diary, it is evident that the witnesses have identified the petitioner while committing the offence and there is one more case pending against the petitioner.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. The same is rejected in Parsa P.S. Case No. 44/2016, corresponding to G.R. No. 1622 of 2016, pending in the court of the learned C.J.M., Saran at Chapra.
