10-08-2016 Heard Sri Vipin Kumar, learned counsel for the petitioner and Smt. Pronati Singh, learned Addl. Public Prosecutor.
This is the 2nd attempt for grant of bail on behalf of petitioner. Earlier, prayer for bail of the petitioner was rejected on 30-11-2015, vide Cr. Misc. No. 52026 of 2015. The petitioner is in custody in Baruraj P.S. Case No. 141 of 2014 registered for the offence under Sections 363 & 366 of the Indian Penal Code. By order dated 22-06-2016, a report was called for from the court below, which has been received and kept at flag 'A'. The report dated 19th July, 2016 of learned 13th Addl. District & Sessions Judge, Muzaffarpur makes it clear that in this case, trial is going on and altogether six witnesses have already been
Patna High Court Cr.Misc. No.22926 of 2016 (4) dt.10-08-2016 2/2 examined. Only three witnesses are yet to be examined. In view of the fact that trial is continuing, there is no reason to review my earlier order.
The prayer for bail again stands rejected.
Since petitioner is in custody, the trial court is required to take all steps for expeditious disposal of the case. (Rakesh Kumar, J.) Anay U T
