Learned counsel for the appellant Dhananjay
Patna High Court L.P.A No.1653 of 2018 dt.16-08-2022 2/2 Ram @ Dhanjay Ram submitted that his right is affected by virtue of learned single Judge order dated 27.03.2018 passed in C.W.J.C. No. 4592 of 2018.
It is submitted that he is not arrayed as necessary and proper party to C.W.J.C. No. 4592 of 2018. In the light of these facts and circumstances, present L.P.A. filed by appellant Dhananjay Ram @ Dhanjay Ram is not maintainable in the light of Apex Court's decision in the case of Shivdeo Singh & Others Vs. State of Punjab & Others reported in AIR 1963 SC 1909.
Accordingly, the present L.P.A. stands disposed of reserving liberty to the appellant Dhananjay Ram @ Dhanjay Ram to prefer writ petition in seeking recalling the order dated 27.03.2018 passed in C.W.J.C. No. 4592 of 2018, in accordance with law.
