2. The petitioner seeks bail in a case registered for offence under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 653.040 liters of illicit foreign liquor has been recovered from the verandah of newly constructed house of this petitioner.

4. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of petitioner and recovery has been made from the house, which is in joint possession of the family. Petitioner has got no concern with the alleged recover and he is in custody since 15.04.2024.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise - 02, Samstipur in connection with Excise P.S. Case No. 100 of 2020.
