Petitioner apprehends his arrest in connection with Kudra P.S. Case No.361/2022, registered for the offence punishable u/s 392, 395, 397, 412, 414 of the IPC.

As per the prosecution case, four unknown miscreants caught the informant when he was going to ease out in between his duty and assaulted him. Thereafter, they snatched Rs.One Lac Thirty Thousand, gold locket, transferred money from his phone through Pay phone and snatched his mobile with SIM. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He is not named in the F.I.R. and has been falsely implicated in this case. F.I.R. was lodged against unknown miscreants. Name of

No.36203 of 2023(3) dt.28-08-2023 2/2 petitioner transpired in this case when during investigation, one apprehended co-accused namely Abhimanyu Kumar Singh @ Manu Yadav took his name as being involved in the said occurrence. Petitioner has no concern with the said co-accused. No incriminating article has been recovered from the conscious physical possession of the petitioner and he has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case, considering the nature of allegation and the statement of the coaccused, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.
