JUSTICE MADHURESH PRASAD ORAL ORDER 03-04-2019 Counsel for the petitioner submits that description of father's name in the cause title of order dated 11.8.2015 passed in CWJC No. 12259 of 2015 suffers from an error of inadvertance. He submits that from Annexure 2 to the writ petition it is evident that petitioner's father name is Late Yogendra Singh. Due to typographical error in the cause title of the petition filed in the said writ proceeding father's name has wrongly been typed as Kunwar Singh. Accordingly the name of Kunwar Singh as father's name of petitioner is reflected in the order dated 11.8.2015. The same arises out of an error of inadvertance committed by the petitioner in the cause title of the writ petition.
Patna High Court MJC No.2111 of 2017(4) dt.03-04-2019 2/2 Submission of the petitioner is found to be correct as per annexures to the said writ petition wherein petitioner has consistently been described as son of Late Yogendra Singh and not Kunwar Singh.
Having considered the aforesaid facts and circumstances, this Court would direct that father's name in the cause title of order dated 11.8.2015 passed in CWJC No. 12259 of 2015 be read as Late Yogendra Singh.
The said order stands modified.
