2. The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Gidha P.S. Case No. 23 of 2025, lodged on 21.01.2025, under Sections 127(2)/115(2)/109/3(5) of the Bhartiya Nyay Sanhita, 2023 and under Section 27 of the Arms Act.
3. As per the prosecution, FIR has been lodged against three named accused persons including the present petitioner against whom there is allegation that they have assaulted the
Patna High Court CR. MISC. No.34530 of 2025(2) dt.04-06-2025 2/2 informant. Specific allegation against the petitioner is that he has fired by pistol with a view to kill and firing was made repeatedly due to which the informant sustained injury on his shoulder.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the FIR is absolutely false as the informant is a member of the gang and petitioner has been made unnecessarily accused in this case. Counsel submits that antecedent of the petitioner is not clean. There are three criminal antecedents against the petitioner. Counsel submits that petitioner is in custody since 26.03.2025.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that there is specific allegation against the petitioner of firing not only once rather repeatedly.
6. In this background, this Court is not inclined to grant bail to the petitioner. Hence, the prayer for bail of the petitioner is hereby refused.
