2. The petitioner seeks bail in Sadar Muzaffarpur P.S. Case No. 445 of 2020, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. 1435.320 litres of foreign liquor has been recovered from Bolero vehicle and pick-up van.
4. It is submitted that petitioner petitioner's name has surfaced in this case on the disclosure made by the co-accused persons who were apprehended by the police. Petitioner is owner of the pick up vehicle in question and the vehicle was being driven by one Ashok Kumar and petitioner was not aware of the nature of consignment being transported by his pick up van. No recovery has been made from conscious possession of
Patna High Court CR. MISC. No.37878 of 2024(2) dt.23-08-2024 2/2 this petitioner. Petitioner claims clean antecedent and he is in custody since 10.4.2024. Investigation is complete. Co-accused, with similar allegation, has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No. 27845/2021.

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No.1, Muzaffarpur in connection with Sadar Muzaffarpur P.S.
