Petitioner seeks bail in a case registered under sections 302, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case in short is that the nephew of the informant was sitting in his darwaja. In the meantime Shambhu Jha, Md. Sahub Khan, Md. Kabir Alam, Md. Shahid, Md. Akbar, Md. Saddam, Md. Nasruddin and son of Md. Jaan came there and took the nephew of the informant Amod Sah @ Guddu for Panchayati. It is alleged that the informant also went with them and near the masjid under conspiracy to each other fired indiscriminately upon Amod Sah @ Guddu.

No.27497 of 2015 (2) dt.31-07-2015 2/2 It is submitted on behalf of the petitioner that petitioner is in custody since 10.12.2014 and charge sheet has been submitted in the case. It is further submitted that petitioner has no criminal antecedent. It is submitted that petitioner is not named in the first information report. There is no direct or indirect evidence to suggest the implication of the petitioner in the present case.

On behalf of the State it is submitted that petitioner's name has come during the course of investigation. Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Sitamarhi in Belsand P.S. Case No. 141 of 2014.
