JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-08-2022 Though, the present writ petition has been filed seeking quashing of the notice dated 08.06.2022 issued in Encroachment Case No. 05 of 2022-2023 by the Municipal Commissioner, Municipal Corporation, Purnea, however, the learned counsel for the petitioner has limited his prayer to grant of liberty to the petitioner to file his show cause reply to the said notice dated 08.06.2022, however, has sought some protection in the meantime.

Accordingly, the present writ petition stands disposed of with liberty to the petitioner to file appropriate show cause

Patna High Court CWJC No.9324 of 2022(2) dt.11-08-2022 2/2 reply to the aforesaid notice dated 08.06.2022 and in case such a show cause reply is filed within a period of four weeks from today, appropriate order shall be passed thereon within a period of 12 weeks, thereafter.

It is needless to state that in case appropriate show cause reply is filed within a period of four weeks from today, status quo existing as on today shall be maintained till passing of the final order by the Municipal Commissioner, Municipal Corporation, Purnea.

The writ petition stands disposed of on the aforesaid terms.
