JUSTICE SUDHIR SINGH ORAL ORDER 01-07-2019 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners seek bail in a case registered under Sections 147, 341, 323, 324, 307, 427, 504, 506 of the Indian Penal Code.

Allegation is that the accused persons including the petitioners assaulted the informant, his son and nephew by means of farsa, due to which they sustained injuries. It has been submitted on behalf of the petitioners that the petitioners are in custody since 26.03.2019 and have got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.33039 of 2019(3) dt.01-07-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioners. It is a case and counter case between the parties. The petitioners are alleged to have assaulted on the head of the victim. The nature of injury on the head is said to be simple. Other co-accused are said to have caused injury upon the victim, which is on non-vital party of the body. On behalf of the State and learned counsel for the informant, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Saran at Chapra in connection with Dariyapur P.S. case No.99 of 2019.
