The petitioners are languishing in custody since 03.04.2019 in a case registered for the offences punishable under Sections 419,420,467,468,471 of the Indian Penal Code and Section 66 of the I.T. Act.

The petitioners were apprehended on the basis of suspicion that they weer indulged in the offence of forgery and Cyber related crime.

It is submitted by learned counsel for the petitioners that the accusation is not specific and merely on suspicion, the FIR has been lodged. It is further submitted that even assuming the accusation to be true, no offence is made out

Patna High Court CR. MISC. No.34188 of 2019(2) dt.27-05-2019 2/2 against the petitioners. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent.

Learned APP for the State submits that on the basis of secret information the petitioners were apprehended. Considering the nature of accusation coupled with statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-1, Nalanda in connection with Giriyak (Katrisarai) P.S. Case No.127 of 2019.
