The petitioner seeks bail in Sabour (Goradih) P.S. Case No. 44 of 2021, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and section 25(1-b)a, 26 and 35 of the Arms Act.

4.5 litres of foreign liquor has been recovered from house of this petitioner.

It is submitted that no recovery has been made from conscious possession of this petitioner. Recovery has been made from house which is in joint possession of family. It is further submitted that for recovery of country made rifle, cartridge etc. a separate case was registered against petitioner for the same

Patna High Court CR. MISC. No.46181 of 2021(2) dt.16-11-2021 2/2 offence. Petitioner is in custody since 27.02.2021. Investigation is complete.

Considering the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II-cum-Special Judge (Excise Act), Bhagalpur in connection with Sabour (Goradih) P.S. Case No. 44 of 2021.
