Petitioner seeks bail in a case registered under sections 395, 397 of the Indian Penal Code.
Prosecution case, in short, is that on 10.08.2014 at 9.30 A.M. he along with his co-villagers went to meat his maternal uncle on a motorcycle bearing registration No. B.R-28G3257 and at 3.30 P.M. he was talking on phone near Daibhate Bridge in the meantime six persons on three motorcycle came there and all of them were hidden their face excepting one, pointed pistol on him and assaulted him with slap and snatched the key of the motorcycle, took out Rs. 10000/- from his pocket besides mobile and filed away.

No.27481 of 2015 (2) dt.31-07-2015 2/2 It is submitted on behalf of the petitioner that petitioner is in custody since 23.12.2014 and charge sheet has been submitted in the case. It is further submitted that petitioner is not named in the F.I.R. There is no recovery from the possession of the petitioner. Petitioner has not been put on T.I.P to suggest his implication in the present case and other accused has been granted bail.
On behalf of the State it is submitted that petitioner's name has come during the course of investigation. Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in Uchakagaon P.S. Case No. 195 of 2014.
