JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-05-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim is languishing in custody since 25.8.2015 in a case registered for the offences punishable under Sections 498A and 304B/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act. The accusation is of killing the sister of the informant after five years of marriage for non fulfillment of dowry demands. It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general.
The impugned order reflects that three witnesses have been examined.
Considering the fact that the case was registered in 2002 and the petitioner was arrested on 25.8.2015, this court is not
Patna High Court Cr.Misc. No.20714 of 2016 (2) dt.10-05-2016 2/2 inclined to grant bail to the petitioner at present in connection with Supaul P.S. Case No. 102 of 2002 pending in the court of learned ADJ II, Supaul.
This application is, accordingly, dismissed. However, let the trial be expedited.
