The petitioner has preferred this application for grant of regular bail in a case registered under sections 406, 420, 467, 471, 120B and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, on information having been received, the house of the petitioner was raided. Four persons managed to escape. The petitioner was caught and two mobile phones, various details of different accounts as also that of his mother and father were recovered.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in
Patna High Court CR. MISC. No.44695 of 2021(2) dt.25-01-2022 2/2 the case. No incriminating material has transpired in course of investigation to connect the petitioner with the alleged crime. The petitioner had no knowledge about the recovered wine, the alleged recovery being from the ancestral property. The petitioner is in custody since 26.3.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for about 10 months, the Court directs the petitioner to be enlarged on bail in connection with Ariyari (Kasar O.P.) P.S. Case no.25 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II, Sheikhpura.
