In this case petitioner is seeking bail in Bodh Gaya P.S. Case No. 278 of 2013 registered under sections 302/34 of the Indian Penal Code and 3(2)(V)SC/ST Act. As per the allegation made in the first information report the husband of the informant was missing and later on his dead body was found in the morning hanging from a tree. The informant has named the petitioner on the basis of suspicion.
Learned counsel for the petitioner submitted that except suspicion there is no any other material against the petitioner and he has been implicated in this case only on suspicion . Co-accused Umesh Yadav against whom there is
Patna High Court Cr.Misc. No.16902 of 2015 (2) dt.15-06-2015 2/2 similar allegation has been granted bail by this Court in Cri. Misc. No. 40871 of 2014.
Considering the aforesaid facts, petitioner Nanka Yadav @ Nanhaku Yadav is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case no. 278 of 2013.
