JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but omnibus allegation of setting fire has been levelled against the petitioner and co-accused, Janki Paswan, who happens to be father of the petitioner.
The submission on behalf of the petitioner is that much prior to institution of the present case, Buniyadganj P.S. Case No. 112 of 2013 was lodged against the informant and others by the petitioner and as a matter of fact, in retaliation to the above stated case, the present case has been lodged against the petitioner. It is further submitted by him that except the informant not a single person claims to have seen the petitioner setting fire on the
Patna High Court Cr.Misc. No.27300 of 2015 (2) dt.31-07-2015 2/2 house of the informant. It is further submitted by him that moreover, both parties have settled their dispute by happy note of compromise.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar Pandey, Judicial Magistrate 1st Class, Gaya in connection with Buniyadganj P.S.
