The petitioner apprehends his arrest in Ekangarsarai P.S. Case No. 46 of 2019, registered for the offences punishable under Sections 341, 323, 307, 337, 504, 506 and 34 of the Indian Penal Code.

Prosecution case is that while the informant Dhano Devi was at her house, the accused persons namely, Parmanand Choudhary and Tuntun Choudhary assaulted her son and accused Parmanand Choudhary assaulted her son by means of iron rod, on account of which her son sustained injury over his head. Petitioner assaulted informant's son by means of stick and brick as a result whereof, her son sustained injury. It is submitted on behalf of the petitioner that so far as

Patna High Court CR. MISC. No.33345 of 2019(2) dt.31-07-2019 2/2 petitioner is concerned, there is allegation against him that he assaulted informant's son by stick and brick. Specific allegation of assault by iron rod is upon the co-accused Parmanand Choudhary. Moreover, injuries have been found to be simple caused by hard and blunt substance. Petitioner has got no criminal antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Hilsa (Nalanda) in connection with Ekangarsarai P.S. Case No. 46 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
