JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Dumaria P.S. Case No. 69 of 2014 registered under Sections 365 and 366(A)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but later on, the name of the petitioner has come along with Bhim Paswan and Navin Paswan in the statement of victim recorded, under Section 164 of the Cr.P.C., to the effect that petitioner and Navin Paswan got down the drain at Ranchi and Bhim Paswan along with unknown took the victim at Tamilnadu. It is further submitted that petitioner lodged Dumaria P.S. Case No. 65 of 2014 on 30.07.2014 under
Patna High Court Cr.Misc. No.22012 of 2016 (3) dt.27-07-2016 Section 386/34 of the Indian Penal Code and 17 of the C.L.A. Act against the informant of the present case due to that reason petitioner has falsely been implicated in this case only to give undue pressure. It is further submitted that petitioner has no criminal antecedent and is in custody since 01.04.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sherghati, Gaya, in connection with Dumaria P.S. Case No. 69 of 2014. Out of two sureties, one surety must be the close relative of the petitioner s.
