2. Prayer for bail of this petitioner was lastly rejected by this court vide order dated 29/03/2022 passed in Cr. Misc. No.59094/ 2021.

3. The trial court report reveals that till date out of 11 charge sheet witnesses only one witness has been examined and rest 10 witnesses are yet to be examined. Petitioner is in custody since 20/09/2016 and prior to that he has remained in custody for more that two and half years and as such he has remained in custody for more than nine years.

4. Learned counsel appearing for the State opposes the prayer for bail.

5. Considering the facts of the case, period of custody

Patna High Court CR. MISC. No.38332 of 2023(3) dt.09-08-2023 2/2 of the petitioner and tardy progress of the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Masaurhi, Patna in connection with Dhanarua PS case No. 266/ 2012.
