We have heard Mr. Amaresh Kumar Sinha, learned counsel for the appellant-petitioner and Mr. Anil Kumar Verma AC to AAG-9 for the State.

A delay of 6 years and 117 days cannot be justified and looking into the reasons assigned by the learned Single Judge for rejecting the claim advanced, we are also not persuaded on merits.
