The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 77.4 litres of IMFL and 165 litres of country liquor was recovered from the house of the petitioner.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. He has been falsely implicated in the case. The alleged recovery is from the house belonging to the joint family. The petitioner is in custody since 1.4.2021. He has

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent and having remained in custody for more than 9 months, the Court directs the petitioner to be enlarged on bail in connection with Brampur (K.B) P.S. Case no. 163 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum- Excise Court, Buxar. (Partha Sarthy, J) Prakash/- U
