Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Jakkanpur P.S. Case No. 735 of 2019 lodged under Sections 363, 365 of the I.P.C.
As per the prosecution case, the allegation of kidnapping is there in the F.I.R. It has been named that the muscleman of present petitioner has committed all the occurrence.
Learned counsel for the petitioner submits that as per the F.I.R. itself, there is no role of the present petitioner. As per the narration of the victim and the informant both in 164
Patna High Court CR. MISC. No.35814 of 2022(2) dt.19-09-2022 2/2 statement also, there is specifically no direct allegation against the present petitioner.
Learned counsel for the State opposes the prayer for bail and submits that it transpires that the entire occurrence has caused only and only on the instigation of the petitioner. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present but it is hereby directed to the Trial Court/Lower Court to release the petitioner on bail after framing of charge in this case imposing its own condition so that he shall not evade his appearance during trial.
With this observation, the bail application stands rejected.
