2. The present petition has been preferred for the grant of the following relief(s):

(i) for the issuance of an appropriate writ of Mandamus, commanding the Respondent authorities for paying the lease money of Rs. 746400.00, which accrued due to the acquisition of his

Patna High Court CWJC No.8979 of 2026(4) dt.20-07-2026 2/3 land for the construction of An embankment in the District of Darbhanga is due since 18.01.2025, and the authorities are bound under the Perpetual lease agreement to pay the said amount within a period of six months for which a registered Perpetual Lease Agreement was executed by the authorities bearing registered deed no. 907/18.01.25, along with the interest acquired.

(ii) for all the consequential benefits arising out of the order of this Hon'ble court in this matter.

(iii) for issuance of any other appropriate writ/writs/order/Direction for which this petitioner shall be found fit under the facts and circumstances of the case.

3. Pursuant to the last order, the Executive Engineer, Flood Control Divison, Hathaudi (Samastipur), Mr. Khurshid Ahmed is present in the Court and a counter affidavit has also

Patna High Court CWJC No.8979 of 2026(4) dt.20-07-2026 3/3 been filed showing payment of Rs.7,46,400/- to the petitioner vide letter no. 95 dated 15.07.2026, a copy of which has already been handed over to the learned counsel for the petitioner.

4. In that background, nothing remains and the concerned officer submitted that he has joined the office on 09.07.2026 and immediately day after he took cognizance of the matter and has made payment.

5. Learned counsel for the petitioner submits that he be granted liberty to agitate the matter if any grievance still remains, said liberty is always there.

6. The writ petition is disposed of with the aforesaid observation.

7. The personal appearance of Executive Engineer, Flood Control Division, Hathaudi (Samstipur), Mr. Khurshid Ahmed stands dispensed with.
