JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Kasim Bazar P.S. Case No. 73 of 2015 registered under Sections 341, 323 and 324/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that six persons named in the F.I.R. including the petitioner variously armed with Lathi, Danda, Axe and Rivolver came near the informant and started to cause assault. In that course, co-accused, Amla Devi, caused injury at the head of the informant through Axe. When father and other family members of the informant came to save him then they were also assaulted by them. At that time, petitioner fired in the air and

Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner and others to cause assault to the informant with further allegation to make fire in the air due to land dispute. It is further submitted that petitioner in accused in two other cases, but in both cases, he is on bail and is in custody since 24.06.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Munger, in connection with Kasim Bazar P.S. Case No. 73 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
